In its ruling on Donald Trump’s Georgia election interference case, the Georgia Court of Appeals has scheduled oral arguments in Trump’s appeal of Fani Willis’s disqualification decision for December 5, one month after November’s presidential election.
The court has ordered a stay of the case pending the outcome of the appeal, and the new trial schedule will postpone the case until after the November election.
Trump and his co-defendants’ appeal seeks to overturn a lower court decision that allowed Fulton County District Attorney Fani Willis to continue on the case after it was revealed she had a romantic relationship with special prosecutor Nathan Wade, who resigned at the judge’s order.
Willis urged the court to dismiss Trump’s appeal on several grounds, including that there was “insufficient evidence” to overturn the lower court’s ruling.
Trump and 18 others pleaded not guilty last August to all charges in a wide-ranging organized crime indictment alleging they tried to overturn the results of the 2020 presidential election in Georgia. Four defendants subsequently took plea deals in exchange for agreeing to testify against the others.
The former president has denied all the charges and criticized the local prosecutor’s investigation as politically motivated.
